These Terms & Conditions ("Terms") govern your access to and use of the website at homepestsafe.site (the "Site") and any services provided by Home Pest Safe, LLC ("Home Pest Safe," "we," "us," or "our"). By using the Site or engaging our services, you agree to be bound by these Terms.

1. Acceptance of terms

By accessing or using the Site, you confirm that you are at least 18 years old (or have the consent of a parent or guardian) and that you accept and agree to comply with these Terms. If you do not agree, do not use the Site.

2. Services

Home Pest Safe provides residential and commercial pest management services within designated service areas. All services are subject to:

  • A pre-service property assessment
  • Written authorization to begin treatment
  • Compliance with applicable federal, state, and local laws and regulations
  • The terms of the specific service agreement signed at the start of work

3. Quotes & pricing

Quotes are valid for 30 days from the date issued. Pricing displayed on the Site reflects standard residential service within the standard service radius and is subject to change. Final pricing is confirmed in the written service agreement before any work begins.

4. Scheduling, cancellation, and rescheduling

Service appointments are scheduled in two-hour windows. Customers may reschedule a visit with at least 24 hours notice without penalty. Cancellations or reschedules with less than 24 hours notice may be subject to a $45 trip fee. Recurring service plans may be cancelled with 30 days written notice. There is no early-termination penalty.

5. Payment

Payment is due at the time of service unless otherwise specified in a written agreement. Accepted payment methods include credit/debit card, ACH transfer, and check. Returned-payment fees of $35 may be applied to bounced checks or chargebacks initiated without prior contact with Home Pest Safe.

6. Service warranty

Home Pest Safe warrants that services will be performed in a workmanlike manner consistent with industry standards. If a covered pest issue returns within the active service-plan window, Home Pest Safe will re-treat the affected area at no additional charge. The warranty does not cover:

  • Damage to structure, contents, or landscaping pre-existing the service date
  • New infestations of species not addressed in the original treatment plan
  • Re-infestation caused by changes to the property after service (renovation, landscaping, leaks)
  • Properties where the recommended exclusion or repair work was declined by the customer

7. Customer responsibilities

To enable effective service, customers agree to:

  • Provide accurate information about pest activity and property conditions
  • Allow reasonable access to the property at scheduled times
  • Disclose pets, children's play areas, allergies, and any sensitivities
  • Follow re-entry guidance and any post-service instructions provided in writing
  • Address recommended structural, sanitation, and landscaping items required to maintain results

8. Limitation of liability

To the fullest extent permitted by law, Home Pest Safe's total liability for any claim arising out of or related to these Terms or our services shall not exceed the amount paid by the customer for the service in question during the twelve months preceding the claim. Home Pest Safe is not liable for indirect, incidental, consequential, special, or punitive damages of any kind.

9. Indemnification

You agree to indemnify and hold harmless Home Pest Safe, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site or services.

10. Intellectual property

All content on the Site — including text, graphics, logos, images, and software — is the property of Home Pest Safe or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

11. User-submitted content

Any content you submit through the Site (including reviews, photos, or messages) may be used by Home Pest Safe in connection with our services and marketing, with attribution where appropriate. You represent that you own or have the necessary rights to all content you submit.

12. Third-party links

The Site may contain links to third-party websites. Home Pest Safe is not responsible for the content, policies, or practices of those sites.

13. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis. Home Pest Safe disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Service-specific warranties are governed by the applicable service agreement.

14. Governing law & jurisdiction

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Kings County, New York. You consent to the exclusive jurisdiction of those courts.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

16. Changes to these terms

Home Pest Safe may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
